How crypto exchanges are regulated in USA

The United States does not have one crypto regulator; it has a stack of them. At the federal level every exchange serving Americans must register with FinCEN as a Money Services Business, which brings full AML and reporting obligations. On top of that sits a patchwork of state money transmitter licenses, meaning a platform technically needs approval from up to 50 separate state regulators before it can legally onboard the whole country. This is why so few global exchanges bother.

New York deserves its own mention. The NYDFS BitLicense, introduced in 2015, is expensive and slow enough that the list of exchanges available to New Yorkers is noticeably shorter than for the rest of the country. If you live in NY, check availability before funding an account anywhere. Coinbase, Kraken and Gemini hold the deepest licensing stacks in our dataset, and Gemini was built in New York specifically around the BitLicense.

Then there is the SEC versus CFTC turf question: the SEC treats many tokens as securities, the CFTC claims derivatives and commodities like BTC and ETH. Enforcement actions rather than clear rulebooks have defined the last few years, though the situation is slowly improving. Practical takeaway from our testing: US-regulated venues list fewer tokens and offer no offshore-style leverage, and that is the trade-off for keeping your funds inside the licensed perimeter.

Deposits, withdrawals and local rails in USA

ACH is the default funding rail on every US exchange we track: free, but slow at 3-5 business days, and most platforms place a withdrawal hold on ACH-funded purchases that can run a week or more.
